                             RESOLUTION NO.   20258 
                  
                  
                   A RESOLUTION AUTHORIZING THE MAYOR TO FILE
                   WRITTEN NOTICE WITH THE COMMISSIONER OF THE
                   TENNESSEE DEPARTMENT OF LABOR, ACCEPTING THE
                   PROVISIONS OF THE WORKERS' COMPENSATION LAW
                   FOR EMPLOYEES OF THE CHATTANOOGA-HAMILTON
                   COUNTY AIR POLLUTION CONTROL BOARD.

       	    	 WHEREAS, the Chattanooga-Hamilton County Air Pollution
       Control Board ("the Board") has recommended and requested that 
the
       governing bodies of Chattanooga and Hamilton County file written
       notice with the Commissioner of the Tennessee Department of Labor 

       ("the Commissioner"), pursuant to provisions of the Workers'
       Compensation Law, Tennessee Code Annotated, Section 50-6-106(5)
       ("the Law"), a copy of the Board resolution being attached hereto 

       and incorporated herein by reference; and,
       	    	 WHEREAS, the request of the City of Chattanooga to
       accept the provisions of the Law is limited to employees of the
       Board and does not extend to any other persons, agency or
       department of the City of Chattanooga;
       	    	 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
       THE CITY OF CHATTANOOGA, TENNESSEE, That the Mayor be and is
       hereby authorized to file a letter of acceptance with the
       Commissioner in accordance with the Law for the purposes stated;

       provided, however, that any letter of acceptance be limited to 
the
       employees of the Board.
